Sgt. Gary Stein might be saying things about President Obama that a lot of Marines think, but some are saying he took it too far.
Stein has come under fire for stating on Facebook that he wouldn’t follow certain orders given by his commander in chief. And Marines say Stein’s not alone in his disapproval. More anti-Obama talk is being heard in the workplace and new Military Times poll data shows declining approval among military service members for the president’s job as commander in chief.
The Marine Corps depends its chain of command structure, especially in a time of war. Some Marines say Stein and other vocal Marines like him are undermining that system.

You are all correct. No Marine or member of the military is obligated to follow unlawful orders. Also the oath that we all swore to “support and defend the CONSTITUTION against all enemies, foreign AND domestic!” We will not follow unlawful orders, especially orders that are counter to the Constitution! Our allegiance is not to the President, nor the person in the office, but the Constitution! Nobama is in for a rude awakening if he tries to use his new Executive order from 12 March 2012 in order to impose ‘order’ in the country! (His potential attempt to impose martial law will be unlawful and he will end up in the Brig!)

This is not the Corps I grew up in.
Marines don’t have the luxury of having political opinions. This man is the Commander in Chief, like it or not. This Marine should be dealt with according to the UCMJ. If his chain of command won’t do it, they should be replaced. I am no fan of the president but this is not how the military works. This is a fundamental breakdown of the essence of the Marine Corp.

How different would Katrina have looked if we had this kind of executive power available – as well as the ability to deploy FEDERAL troop & Engineers/Sea-Bee’s into the area at a moments notice.
The anarchy in the streets would have been quelled almost immediately. The fiasco in the Superdome would have been averted, and Marines would have lead the way to recovery with humanitarian evacuation with Ch-46 & 53’s.
Think of what would happen in a tsunami without this? We need our Marines,other service branches, and resources to provide during an attack from any domestic enemy – ever if that enemy is an act of God.

The usual fine line between legal and illegal orders is not so fine these days.
First, the practice of undeclared wars has to end. And when war is declared, the military must be unfettered in its mission. Let’s face it… We basically completed our mission in Afghanistan within weeks of its start back in 2001. It is the politicians that have created the mess that our soldiers find themselves in today.
We really need to take a good hard look at our priorities and observe the constitution when decisions are made. The last three years has seen this document trampled on and disrespected in a big way.
No more sending our young people to wage war without the specific approval of Congress and when such action is approved, it should be explicit and accomplished quickly. Leave the “nation building” to others.
I know well what today’s soldier’s face everyday as I saw the same in Vietnam. No more being assigned with a hand tied behind your back…

First, as Marines we do not independently select our leadership at the top. We carry out the orders that may be given from time to time.
Secondly, splitting hairs over whether or not he is legal, illegal, socialist, not socialist, pro-military, anti-military etc. is a worthless discussion to be had. You vote based on your belief, conviction, and in hope that the guy/gal you are voting for upholds the same principles you would like to see, plain and simple.
When you lose an election to someone who does not believe what you believe, or is fundamentally changing what you would like to see…guess what? There’s always next election. That is the way the ball rolls, fortunately and unfortunately.
Thirdly, the good Corpsman (pronounced correctly by me by the way :)) made an excellent point above that I think really drives at what should be the focus here. The disrespect levels of today’s society is out of freaking control. Not just in the military, but world wide. Social media (like what I am using now) has taken over some of our lives. My 15 year old son cannot string a sentence together, but by golly he sure can text 80 words a minute! Now there’s a skill that will take him far in life. For the older generation (boomers) 50 year old and older, it is time for you guys to start acting your age and stand up for what you were taught by the greatest generation of folks. Don’t go into debt, it is irresponsible. Respect your elders and those of authority, it is responsbile. Abide the law and those that enforce it, it is repsonsible. Get a freaking job and keep it, until the next one comes along that you want, it is responsible. Further your education, it is responsible. OK why I am posting is because in every election it seems that my military absentee ballots don’t get counted and it is always a small AP story. It should be a mandate that your ballots arrive and are counted on election day. You are NOT absentee. You are standing in front of all of us. Your votes should be counted first. Demand your congressman life flights your ballots to you and gets them back and counted on election day. Why should Michael Moores ballot be counted before yours. When I watch Fox News this Nov I would like to see military votes counted first, not last if at all. We owe you that.

As far as orders go, not only does the Constitution trump all conflicting military orders, but each of us is criminally and civilly liable for carrying out orders which violate the Constitution or which have not been authorized by Congress. Captain George Little of USS Boston found that out the hard way in 1804. In 1801, he had followed President Adams’ orders to take any ships bound for, entering, or leaving French ports. Congress, however, had only authorized capturing American ships bound for or entering French ports. Captain Little captured the Dutch trader “Flying Fish” after it left a French port. The Supreme Court in Little v. Barreme ruled that Little was PERSONALLY liable for damages to the ship and his crew, because the President’s orders were unlawful, exceeding the authority extended by Congress. If the United States has not been attacked and is not in imminent danger of being attacked, the President has no authority to wage war unless authorized by Congress. Period. Any attempt to do so is illegal.

I suggest reading Article II, Section 1 of the Constitution and ask yourself what “natural born” means (Here’s a hint: It’s born of two CITIZEN parents on US Soil, guys… His claimed Father- never was a US Citizen…) Just because he was sworn in does not make him legitimately your CINC. If he gives orders contrary to the UCMJ or to the Constitution, you are following CRIMINAL orders.

In the 4 amendment it states every man has the right to bare arms in order to keep a well regulated militia. I believe from France, Natural born had a meaning when the Constitution was drafted and we do not need Democrats to rewrite history or the constitution.
I submit that Article II’s “natural born Citizen” clause has a fixed and knowable meaning which was established at the time of its drafting and should therefore be interpreted through the eyes of the original Framers that drafted and ratified the clause so as to determine what they intended the clause to mean (original intent theory). I also submit that we should interpret the “natural born Citizen” clause in a way that reasonable persons living at the time of its adoption would have declared the ordinary meaning of the text to be (original meaning theory). This is not living constitutionalism but rather originalism or textualism as applied to interpreting the Constitution. It is this latter approach that I will utilize in this article.
E. Vattel stated in 1758, as translated into English in 1797: “The citizens are the members of the civil society: bound to this society by certain duties, and subject to its authority, they equally participate in its advantages. The natives, or natural-born citizens, are those born in the country, of parents who are citizens. As the society cannot exist and perpetuate itself otherwise than by the children of the citizens, those children naturally follow the condition of their fathers, and succeed to all their rights. The society is supposed to desire this, in consequence of what it owes to its own preservation; and it is presumed, as matter of course, that each citizen, on entering into society, reserves to his children the right of becoming members of it. The country of the fathers is therefore that of the children; and these become true citizens merely by their tacit consent. We shall soon see, whether, on their coming to the years of discretion, they may renounce their right, and what they owe to the society in which they were born. I say, that, in order to be of the country, it is necessary that a person be born of a father who is a citizen; for if he is born there of a foreigner, it will be only the place of his birth, and not his country.” E. In Footnote 1 at the end of Sec. 212, Vattel stated that “as a general rule” the child inherits his father’s citizenship, or his mother’s but only if she is not married.
The first thing that we have to understand about what Vattel wrote is that he made a distinction between a “citizen” and a “natural born Citizen.” A citizen is simply a member of the civil society who is bound to the society by certain duties and subject to its authority. “Citizens” also participate equally in all the advantages the society has to offer. On the other hand, a “natural born Citizen” means much more than just “citizen.” Vattel required that for a child to be a “natural born citizen,” or what he called in French in his 1758 first edition of The Law of Nations or Principles of Natural Law, les naturels, ou indigenes (the “natives or indigines”-The Venus, 12 U.S. (8 Cranch) 253 (1814)), the child must be born in the country to both parents who are also citizens of the same country.
In the original French, Vattel wrote: “Les naturels, ou indigenes, sont ceux qui sont nes dans le pays de parents citoyens,” meaning the “natives or indigines” are those born in the country of citizen parents. Both the Framers and later English translators of Vattel’s treatise replaced the words”natural born Citizen” for the words “natives or indigenes.” From Madison’s notes, we see that there were some delegates who were concerned about foreigners. For example, from Max Farrand’s transcripts of Madison’s notes (August 9 and August 13, 1787), there is the following concerning the House of Representatives eligibility requirements: “Mr. Gerry wished that in future the eligibility might be confined to Natives.” The word “native” occurs multiple times in the notes for these two days. (The phrase “natural born citizen” was not used here by the delegates.). The word “native” was a synonym for the phrase “natural born citizen.” The delegates had already used the term “natural born citizen” when proposing the requirements for President, Vice President, and either House of Congress and later used the word “natives” when referring to eligibility requirements for the House of Representative. There is further evidence of this in at least three works: Blackstone’s “Commentaries on the Laws of England” (see Book the First: The Rights of Persons; Chapter the Tenth: Of People, Whether Aliens, Denizens or Natives.), translations of Quintilian’s “Institutio Oratoria”, and the 1797 English edition of Vattel’s “The Law of Nations or Principles of Natural Law.”
In the beginning of his definition, Vattel required that the children be born of “parents” who are citizens. The use of the word “parents” refers to both mother and father. If he required only one parent such as the father, he would have said “of fathers who are citizens” and not “of parents who are citizens.” He did later refer to “fathers,” but only because wives automatically acquired the citizenship of their husbands the same way children did. Hence, if Vattel meant to focus only on “fathers,” he would have used “fathers” throughout his definition and never mentioned “parents” when he first defined “natural born Citizen,” for there would not have been any need to use the word “parents” when “fathers” would have sufficed. Hence, Vattel would have focused on the citizenship of the father since that citizenship would determine that of both the mother and child. It is also noteworthy that Vattel had no problem allowing the child to inherit the citizenship of the mother when the mother was not married to the child’s father. Given that Vattel in effect really focused on the citizenship of both the child’s father and mother in defining a “natural born Citizen,” Vattel’s definition of a “natural born Citizen” does not violate the equal protection guarantee embedded in the Fifth Amendment’s Due Process Clause. Miller v. Albright, 523 U.S. 420 (1998); Nguyen v. INS, 533 U.S. 53, 121 S.Ct. 2053; 150 L.Ed.2d 115 (2001).

I served 4 years with the United States Army. During my service I had lots of respect for the US Marine Corp. After reading this I am thankful that I was a member of the US Army and not the Marines. If this is what makes up the mental state of the US Marine Corp then the United States is in trouble.

Many of these posters need to reread the Constitution they claim to defend, which states:
“The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States. . .”
President Obama was no accidental President: he was elected by a far more impressive popular and electoral majority than either of his two predecessors ever were. As Americans you have the right to speak out against his policies. As soldiers you have forfeited your right to express disrespect for him personally. An officer who refused to serve overseas on the specious grounds that the President was not qualified under the Constitution (as he most certainly is) was courtmartialled, as he deserved to be.
Many of us did not enjoy serving under President Nixon or President Bush. But we did because we recognized the obligations of citizenship. I suggest you all do the same.

According to US laws, soldiers are not required to follow immoral and illegal orders. This was especially emphasized after WWII, during the Nuremberg trials when Allied forces did not allow German soldiers to plead “I was just following orders”. Of course, the argument lies in what an illegal or immoral order is (beyond the obvious). Also, when I was in the Navy, we took an oath to protect and defend the Constitution of the United States, from foreign and domestic enemies. Has anything changed regarding the oath since I was in Vietnam? Lastly, I’ve talked about the subject of would our military and law enforcement fire upon American Citizens in the even of an illegal act or law, such as the 2nd Amendment right to bear arms being declared unlawful by a Supreme Court or Executive Order. Would they go house to house looking for citizens and their arms. Not ONE said they would do that. Instead, they ALL said they would join citizens in a rebellion against the government. Unless Obama, who I personally don’t like, gives that kind of domestic order or by his actions proves to be a traitor, I think you’ll have to follow the chain of command.
